1. Acceptance of these terms

These Terms of Service (the “Terms”) form a binding agreement between you and VinVerify, LLC, a Delaware limited liability company (“VinVerify,” “we,” “us,” or “our”), governing your access to and use of the websites at vinverify.com, our APIs, and the vehicle history reports and related services we provide (the “Services”).

By creating an account, purchasing a report, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to use the Services. If you are using the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms.

3. The Services

VinVerify provides vehicle history information aggregated from public records, federal and state databases (including NMVTIS- approved sources, NHTSA, and the NICB), and licensed industry partners. We do not generate vehicle history data ourselves and do not warrant that any specific record will be present in any given report.

Reports are informational only. They are not a substitute for a physical inspection by a qualified mechanic, and they do not constitute legal, financial, or warranty advice.

4. Accounts

You may need to create an account to use certain features. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us at support@vinverify.example of any unauthorized use.

5. Pricing, payments, and credits

• Single reports, bundles, and memberships are sold at the prices listed on our pricing pages at the time of purchase.
• Bundle credits do not expire and may be used at any time while your account remains in good standing.
• Membership plans renew automatically each billing cycle until you cancel. Unused membership reports do not roll over beyond 30 days unless your plan explicitly states otherwise.
• All prices are in U.S. dollars. Applicable taxes are added at checkout where required.

6. Refund policy

We offer a 30-day money-back guarantee on unused credits and memberships. Full terms are described in our Refund Policy.

7. Acceptable use

You agree not to:

• Use the Services to make decisions about insurance, employment, credit, or housing in a way that would make the Services a “consumer report” under the U.S. Fair Credit Reporting Act (FCRA). VinVerify is not a consumer reporting agency.
• Resell, sublicense, or redistribute VinVerify reports or underlying data to third parties without a written commercial agreement.
• Scrape, crawl, or harvest data from the Services using automated means, except via our official API under a valid API key.
• Attempt to circumvent rate limits, technical restrictions, or billing controls.
• Use the Services to harass, defame, or violate the legal rights of any person.

8. Intellectual property

The Services, including our reports, software, and brand assets, are owned by VinVerify or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Services and the reports you purchase for your personal or internal business use, subject to these Terms.

9. Data accuracy & disclaimers

We pull from authoritative sources but cannot guarantee that any record is complete, current, or free from error. Some events (off-record accidents, undocumented mileage rollbacks, private repairs) may never appear in any vehicle history report.

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, VinVerify and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services. Our total aggregate liability for any claim arising out of these Terms or the Services shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100).

11. Indemnification

You agree to defend, indemnify, and hold harmless VinVerify and its affiliates from and against any claims, damages, or expenses arising out of your breach of these Terms or your misuse of the Services.

12. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or pose a risk to the Services or other users. You may stop using the Services at any time. Unused non-membership credits remain available for refund under our refund policy for the periods stated there.

13. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising out of these Terms or the Services shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction in those courts.

14. Changes to these terms

We may update these Terms from time to time. If we make material changes, we’ll post a notice on this page and, where practical, email you. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
